3.3 Refund Policy – Unless otherwise stated, all sales are final. Refunds are only issued in cases of service failure attributable to ProxyLabs.agency.

4. Intellectual Property

4.1 Ownership – All content, trademarks, and branding on ProxyLabs.agency are the property of ProxyLabs.agency or its licensors.

4.2 License – Users are granted a limited, non-exclusive, and revocable license to use our Services. You may not copy, modify, distribute, or sell our content without prior written permission.

5. Service-Level Agreement (SLA)

5.1 Uptime Commitment – ProxyLabs.agency aims to maintain a 99.9% uptime for its Services. However, this is not guaranteed and excludes:

• Force majeure events (e.g., natural disasters, cyberattacks)
• Third-party service failures beyond our control

5.2 Support Response Time –

• Standard Support: Response within 24 hours for general inquiries.
• Premium Support: Priority response within 6 hours for paid service users.

5.3 Service Credits – If uptime falls below 99.9%, affected users may request service credits, but refunds are not guaranteed.

6. Limitation of Liability

To the fullest extent permitted by applicable law, ProxyLabs.agency, its owners, affiliates, employees, agents, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to:

• Use or Inability to Use the Website – Including, but not limited to, service interruptions, technical issues, errors, or downtime.
• Third-Party Services or Content – Any actions, products, or services provided by third-party providers, affiliates, or external links.
• Loss of Data or Security Breaches – Unauthorized access, hacking, or data loss resulting from use of our services.
• Financial or Business Losses – Including lost profits, revenues, or anticipated savings.
• Legal or Compliance Issues – Use of ProxyLabs.agency services in violation of laws, regulations, or third-party agreements. 

By using ProxyLabs.agency, you acknowledge that your use of the site and services is at your own risk, and you agree to indemnify and hold harmless ProxyLabs.agency from any claims or liabilities arising from such use. 

If any portion of this limitation of liability is found to be unenforceable, our total liability shall not exceed the amount paid (if any) for services provided through ProxyLabs.agency.

7. Indemnification

You agree to defend, indemnify, and hold harmless ProxyLabs.agency, its affiliates, employees, and partners from any claims, damages, liabilities, or expenses (including legal fees) arising from:

• Your use or misuse of our Services.
• Your violation of these Terms or applicable laws.
• Any third-party claims arising from content you submit or actions you take using ProxyLabs.agency.

8. DMCA Compliance (Copyright Infringement Policy)

8.2 Counter-Notification – If you believe content was removed by mistake, you may submit a counter-notification. ProxyLabs.agency will evaluate disputes in compliance with the DMCA process.

9. Termination of Services

We reserve the right to suspend or terminate your access to ProxyLabs.agency at any time, with or without cause, including but not limited to violations of these Terms. Upon termination, your rights to use our Services cease immediately.

10. Governing Law & Dispute Resolution

10.1 Governing Law – These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. 

10.2 Dispute Resolution – Any disputes shall first be attempted to be resolved informally. If unresolved, disputes shall be settled through binding arbitration in the State of Arizona, unless otherwise required by law.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of ProxyLabs.agency after any modifications constitutes acceptance of the new terms.
